PreMC: 9 bulan untuk dapatkan ‘Audited Account’ dari Desaminium Jaya.

Audited account

Akhirnya setelah hampir 9 bulan menunggu, kini pihak kementerian telah berjaya mendapatkan audited maintenance account bagi tahun berakhir 30 April 2006 dari pihak Desaminium Jaya Sdn Bhd. Usaha ini telah kami lakukan bermula dari bulan Nov 2006, dimana pihak Pre-MC telah memohon dari pihak Desaminium Jaya agar memberikan a/c ini. Namun pihak pemaju sentiasa memberi alasan dan melambatkan pengeluaran audited a/c ini. Sehingga pada bulan April pihak Pre-MC telah membuat laporan kepada Bahagian Pengawasan dan Penguatkuasaan kementerian Perumahan da Kerajaan Tempatan. Dan pada 16 Ogos yang lalu pihak kami telah menerima salinan laporan a/c ini dari pihak Kementerian.

Pre-MC akan mengadakan perjumpaan dengan penduduk dalam jangka masa yang terdekat bagi memberi salinan penuh Audited maintenance a/c ini. Penyata kewangan ini penting bagi memastikan pihak Desaminium Jaya melalui ajennya YBR Management Services menguruskan sumber kewangan Desaminium Rimba dengan berhemat. Saya juga ingin menasihatkan agar semua penduduk dapat membuat bayaran Maintenance charges bagi mengelakkan tunggakan yang tinggi dan akhirnya menimbulkan kesukaran sekiranya anda diminta berbuat demikian dimasa akan datang. Kita mengharapkan agar JMB (Joint Management Body) dapat ditubuhkan secepat mungkin bagi memastikan integriti dalam pengurusan kediaman kita. Diharap penduduk Flora juga boleh meminta Audited A/C bagi tahun 2006 dari pihak pemaju.

Laporkan masalah kebocoran sebelum Oktober 2007

Kepada penduduk yang mempunyai masalah kebocoran (water leaking), keretakan atau apa jua masalah di unit masing-masing, anda dinasihatkan agar membuat laporan kepada pihak YBR Management (En Mustafa) secepat mungkin. Ini kerana pihak YBR akan cuba menyelesaikan masalah ini dalam tempoh terdekat (selewat-lewatnya sebelum Oktober 2007).

Sekiranya anda pernah membuat aduan sebelum ini kepada pihak YBR (samada kepada En Johari, En Raj atau En Ahmad Kamal atau building Manager di Flora) tetapi masalah ini masih belum diatasi, sila bawa bersama salinan aduan anda (sertakan gambar sekiranya ada) kepada YBR.

Bagi anda membuat aduan selepas Oktober 2007, pihak YBR tidak akan membaik pulih kerosakan itu, sebaliknya anda harus menanggung segala kos baik pulih.

RapidKL buses now can enter Taman Desaminium

Thanks to PreMC and PPTD efforts which had sought MPSJ’s assistance for the removal of the horizontal steel bars at the main entrance, RapidKL buses now can enter Taman Desaminium all the way up to Desaminium Rimba blocks for the convenience of all residence. Well done.

Complaint against Desaminium’s unfair maintenance charges goes to KPKT

I am sure all Desaminium owners agree that we are short changed by Desaminium with regards to the high maintenance charges. The facilities that are accorded to the residents are also very much to be desired, to say the least. We were promised condominium facilities and yet what do we get? Other condominiums have everything but our condominium has nothing. Even some medium cost apartments near our our place has more facilities… what a shame to have name such as Taman Desaminium. Maybe Desaminium Jaya should change this project to Taman DesaMINIMUM… that will be more appropriate.

PPTD and PreMC have long recognized this problem and had always been at the forefront in fighting for residents rights to fair charges. However, maybe some residents fail to realize that…. the reasons maybe because there is nothing seem to be done by either PPTD or PreMC.

Well folks, this two-page letter from Kementerian Perumahan dan Kerajaan Tempatan (KPKT) is the proof that PreMC and the Chairman, despite being questioned in this very forum as not having high integrity and what not, cares about the residents and had done something about the high maintenance charges problem.

Because of the complaint lodged by PreMC, the Enforcement Division of KPKT had sent the letter of demand to Desaminium Jaya to furnish them with relevant documents related to the statement of expenses accounts and the audited accounts from Desaminium Jaya.

Once we receive the relevant document, we will publish the documents for all residents to see and judge how fair/reasonable or unfair/unreasonable these maintenance charges imposed by Desaminium on residents.

We would like to stress again, controrary to some popular belief, PreMC and PPTD are two functioning bodies representing all Taman Desaminium residents, although the two associations appear to be run by certain individuals only… but that is because not all elected office bearers are committed enough to work within the team.

If only ALL residents are also committed in supporting the PPTD and PreMC…. we could have achieved much more.

Permohonan untuk tempat letak motorsikal berbumbung

Pihak PreMC ingin membuat permohonan dari pihak Desaminium Jaya dan YBR, agar dapat membuat bumbung bagi tempat letak motorsikal. Ini bagi mengelakkan motorsikal kita rosak akibat dari terkena panas dan hujan. Untuk merialisasikan cadangan ini, pihak PPTD and PreMC memohon agar anda semua dapat menurunkan tandatangan dalam petisyen yang telah saya buat. Anda diminta hadir ke Dewan Serbaguna Desaminium Rimba pada hari Sabtu ini (17 Mac 2007) jam 10:00 pagi – 12:00 tengahari.

Suggestion by a Desaminium resident

Webmaster had received the following suggestion by a resident which I think is good for all. Please read and let us know yout thoughts. I hope PreMC and PPTD will follow up on the suggestion and feedbacks. TQ

I want to suggest that we create a list to identify what are the MOST IMPORTANT issues affecting ALL OF US. We can shortlist it to between 3 to 5 MOST IMPORTANT issues and discuss / share ideas how to solve it (NON IMPORTANT issues can be discussed later).

Probably we can take a poll to list which are the MOST IMPORTANT issues. Let me start the list which I think is MOST IMPORTANT to all of us.

1. Maintenance Charges (MC)
I feel that we are paying very high MC since pratically there are no facilities provided which are costlly to maintain like swimming pool, excellent landscape, GYM, etc.

2. IMPROVE THE LANDSCAPE
This will impress our visitors and hope fully will also improve the market value in the future.

3. PRIMARY AND SECONDARY SCHOOL
We need this schools badlly, this will motivate many house owners to shift to Tmn Desaminum. And also increase the market value for our property.

4. HIGHWAY INTERCHANGE
The PUTRAJAYA Highway should provide access for us to travel to and from KL.

These are issues which are important to me, which I belive are also
important to many others.

Please let us know what is important to you, remember to make it short to TOP 5 issues only.

Title woes still a fact

STRATA titles are important because they grant ownership to individual purchasers, who are not recognised as owners by the Land Office until the titles are issued.

This loophole is worrisome, for should a developer ever go bankrupt, the property’s ownership could be transferred to a fresh developer’s company with a new set of requirements requiring purchasers to pay extra costs or even have the property taken away in default.

Since the issue of ownership is not addressed specifically in any of the Acts, it would be a costly court battle for owners to prove otherwise.

By right, the developer is supposed to apply for strata titles within six months of receiving certificates of fitness.

Section 20(1) of the Strata Title Act states this while Section 20(1a) allows for an extension of a further three months.

Failure to comply with this is covered by Section 22A of the Act, where the developer is liable, on conviction, to a fine not exceeding RM5,000 and a further fine not exceeding RM1,000 for each day the offence continues.

In Penang, the Auditor General pointed out that the Land Office only prosecuted 13 developers for failing to submit the applications, despite sending 144 reminders. (The Star, Oct 7).

The reason for the lack of prosecution given by Deputy Chief Minister Datuk Abdul Rashid Abdullah was that the Land Office only prepares the cases for prosecution to be undertaken by the State Legal advisor, but it was not mentioned how many cases the Land Office had prepared to be acted upon nor was it stated if any of the developers were fined for failing to comply with the Act.

The Housing and Local Government Ministry will be tabling some amendments to the Act to address the concerns of ownership soon.

The Condominium, Appart-ment and High-rise Committee (CAHC), however, asks if the amendments would truly address the issue because strata titles are supposed to be legal documents that spell out ownership.

“While we applaud the amendments, there are some grey areas that need to be clarified,” said CAHC pro tem chairman Tengku Nazaruddin Zainuddin.

“The question involves the delivery system, compliance by the developers and, of course, enforcement.

“There seems to be no enforcement and developers are taking advantage of this. One can amend the Act yearly but if the delivery system, compliance and enforcement are absent, it does not change anything,” said Nazaruddin.

CAHC currently has more than 40 condominium and apartment residents associations under its wing and has managed to solve several issues involving members.

Currently, CAHC is working on problems faced by members ranging from harassment of vocal condominium owners to unexplained rate hikes by management corporations.

Nazaruddin said the committee is working hard to fight for the rights of condominium dwellers using the law, following procedures and documenting the process.

The efforts have yielded results, but Nazaruddin said the government should be the one taking responsibility for the problems caused by a lack of enforcement.

The committee was formed under the All PJ Pro Action Committee (APPAC) banner and consists of members from the APPAC group.

Failed Solutions

The Selangor Land and Mines Office tried to fix the problem of management corporations (MC) by coming up with a Pre MC solution where developers and owners form the MC prior to the issuance of strata titles in early 2005.

Koh…‘There is little we can do.’
The initiative was meant to allow residsents to learn the finer points of running a condominium while preparing them to take over management when the strata titles are issued.

Many developers do not support this and a government officer’s reply to the Kelana D’ Putera Residents Association when they tried to set up a Pre-MC was that the developers cannot be forced to agree.

“There is little we can do because the developer refused to endorse it and we have a useless piece of paper,” said Kelana D’ Putera Residents Association president Francis Koh.

Afer trying for the past seven years to get their strata titles, the Kelana D’ Putera RA was promised its titles at a meeting on Dec 9, 2005.

Selangor housing and property board executive director Alinah Ahmad chaired the meeting, with Land and Mines Office strata and development policy management committee director Dr Azimuddin Bahari and officers from related departments present.

The promise that strata titles would be issued to residents in June 2006 remains unfulfilled.

Follow up attempts by the association went unanswered until recently, with a meeting scheduled for today.

“We don’t know what else to do when the government is either ineffective or unable to process the strata titles for residents,” said Koh.
