Soalan Parlimen Mengenai Peraturan Terkandung Di Dalam Building & Common Property Act 2007.

Puan Teresa Kok Suh Sim (Seputeh) minta MENTERI PERUMAHAN DAN KERAJAAN TEMPATAN menyatakan bilakah Kementerian akan membentangkan peraturan (regulations) yang sepatutnya terkandung di dalam Building and Common Property (Maintenance & Management Act 2007). Apakah Pesuruhjaya Bangunan (Commission Of Buildings) boleh mendakwa pemaju yang enggan mengikut arahannya berdasarkan Seksyen 17(7) dalam akta tersebut.

Terima kasih diucapkan kepada Ahli Yang Berhormat atas soalan ini. Untuk makluman Ahli Yang Berhormat, Kementerian Perumahan Dan Kerajaan Tempatan (KPKT) sedang menyediakan empat peraturan-peraturan (regulations) di bawah Akta Bangunan dan Harta Bersama (Penyelenggaraan dan Pengurusan 2007 (Akta 663). Di samping itu, KPKT juga sedang meneliti dan mengkaji peraturan-peraturan lain yang perlu dibuat bagi mempastikan Akta 663 dapat dikuatkuasakan dengan berkesan.

Selaras dengan Seksyen 42(1) Akta 663, Menteri perlulah mendapat persetujuan daripada Pihak Berkuasa Negeri terlebih dahulu sebelum peraturan-peraturan ini diwartakan dan dikuatkuasakan. Walau bagaimanapun, peraturan-peraturan ini tidak perlu dibentangkan dalam dewan ini.

Seksyen 17(7) Akta 663 memperuntukkan kesalahan bagi mana-mana pemaju yang gagal untuk mematuhi Seksyen 17 Akta 663 tersebut iaitu peruntukan mengenai tanggungjawab pemaju terhadap Akaun Penyelenggaraan Bangunan. Jika disabitkan kesalahan, pemaju boleh dikenakan denda tidak kurang daripada RM 100,000 dan juga denda tidak melebihi RM 1,000 bagi tiap-tiap hari yang kesalahan itu diteruskan selepas sabitan.

Dalam hal ini, apa-apa kesalahan di bawah Akta 663 akan didakwa oleh Pendakwa Raya atau Timbalan Pendakwa Raya atau mana-mana orang yang diberikuasa oleh Pendakwa Raya termasuklah Pesuruhjaya Bangunan.

Dilarang sidai kain terbuka di kediaman bertingkat tahun depan

PUTRAJAYA: Mulai tahun depan, penghuni kediaman bertingkat seperti rumah pangsa dan pangsapuri tidak lagi dibenarkan menyidai pakaian secara terbuka seperti sekarang.

Satu garis panduan berhubung perkara itu akan dikeluarkan kepada pihak berkuasa tempatan (PBT) bagi memastikan bangunan kediaman baru memiliki kemudahan ampaian seperti ditetapkan.

Timbalan Perdana Menteri, Datuk Seri Najib Razak, berkata Pesuruhjaya Bangunan (COB) akan ditugaskan bagi memastikan peraturan baru itu dipatuhi, termasuk menyediakan tempat dan peralatan khusus kepada penghuni kediaman terbabit.

“Kita akan cuba melalui COB untuk ambil tindakan bagi menguatkuasakan perkara ini dan tindakan seperti menyediakan tempat yang khusus dan peralatan yang sepatutnya disediakan akan diambil.

“Sekiranya tindakan ini tidak berkesan maka, pindaan ke atas undang-undang sedia ada akan dipertimbangkan,” katanya selepas mempengerusikan mesyuarat Majlis Negara Untuk Kerajaan Tempatan (MNKT) Ke-61 di sini, hari ini.

Dalam satu taklimat dengan Jawatankuasa Penduduk Zon 19 MPSJ yang diadakan malam tadi, terdapat 3 kes denggi telah dikesan disekitar kawasan Putra Permai. 2 kes di Puncak Jalil 2 (PUJ2) dan satu kes di Lestari Perdana 7 (LP7) yang melibatkan KEMATIAN . Oleh itu satu sesi Taklimat akan diadakan oleh pihak MPSJ pada tarikh dan masa berikut :-

Pihak JMB juga ingin meminta kerjasama dari penduduk agar dapat memastikan tiada bekas takungan air atau sampah yang boleh menjadi tempat pembiakan nyamuk Aedes dikawasan sekitar Desaminium Rimba khususnya didalam rumah. Pihak JMB akan mengambil tindakan dengan membuat pengasapan (fogging) pada hari Khamis atau Jumaat ini bagi mengawal kawasan sekitar kita bebas dari Aedes. Sekali lagi saya mohon kerjasama anda untuk menjaga kebersihan kawasan kita.

AGM to form condominium’s management corporation illegal

This news article is another proof that developers are always the source of the problems in majority of the issues faced by house buyers. Until the government has the political will to amend local by-laws to punish errant developers and protect the house buyers, developers will continue to behave arrogantly and irresponsibly in their dealings.

RESIDENTS of Palm Spring@Damansara in Petaling Jaya have foiled an attempt by the developer to set up the condominium’s management corporation (MC).

Under the Strata Titles Act, a developer is required to submit strata title applications for at least 25% of the total number of condominium units before calling for an annual general meeting (AGM) to form an MC.

The Palm Spring joint management body (JMB) conducted a check with the land office and discovered that developer Muafakat Kekal Sdn Bhd had not fulfilled that requirement. The development comprises more than 2,000 units.

MBPJ councillor Mak Khuin Weng, who was representing the Petaling Jaya Commisioner of Buildings, said it was unlawful for the developer to call for an AGM before that requirement was fulfilled.

Employees of the developer who were present at the AGM registration desk kept mum when questioned by Mak and the residents.

“The person in charge is still on Hari Raya leave,” answered an employee.

Mak said they could not proceed with the AGM until the developer had applied for strata titles for at least 25% of the units and the employees then voluntarily took their belongings and left the premises.

According to Palm Spring JMB secretary Richard Wong, 44, residents had received an invitation dated Sept 19 from the developer to attend an annual general meeting to form the MC for the condominium.

However, residents only received the letter a few days later, which did not comply with the minimum 14 days notice required by the act.

Some residents also voiced their dissatisfaction over the developer’s decision to conduct the meeting on Oct 4 when many Muslim owners were still away for the Hari Raya break.

“We just want things done according to the proper procedure,” said an irate resident, who declined to be named.

Mak said the council would continue to monitor condominium issues relating to joint management bodies and management corporations.

The MBPJ has come up with its own guidelines on how it interprets the Building and Common Property (Maintenance and Management) Act 2007.

The guidelines apply only to cases under the council’s jurisdiction and copies are available at the MBPJ Commissioner of Buildings secretariat.

It also has a set of guidelines for the operations and conduct of the JMB and joint management committee (JMC).

Living in condominium

I find this story quite interesting and relevant to be shared among Desaminium residents. Thanks to Puteri Kamaliah for writing and sharing this rather nice piece of yet another Malaysian ways of life. Yang baik jadikan teladan and yang kurang baik jadikan sempadan.

Pandemonium in Condominium
Are condo walls thinner than the average house wall? It certainly seems so here where we live. Somehow I feel so exposed and vulnerable, with every creak of my bed (ooooh dear!) magnified across a wafer-thin divider.

My children say I am and will always remain paranoid of everything and everyone no matter what the truth. A lot of help they are!

Dear Pak Abu, the logical thinking mathematician not known for his diplomacy at the best of times, thinks the walls are fine. It’s my sense of hearing and attention span he worries about.

The man says it baffles him that I can hear the tiniest noise from upstairs but not his running commentary about the state of Malaysian politics, and why some people tend to nod off to sleep in the middle of meetings and such.

As the norm, I try not to argue with Pak Abu’s observations because he does have a valid point very now and then. Granted, I am pretty opinionated myself and can be as obstinate as a mule sometimes.

Back to the wall issue, I brought up this subject because the people living above us had been having rather over-enthusiastic domestic squabbles lately. You could hear furniture being thrashed and household stuffs flung about.

I assume furniture were broken because I could hear hammerings the following day, presumably of chair legs being reattached and such. The commotion they caused (the fighting and ensuing repairwork) was distracting, to say the least.

Whilst we weren’t nosy-parkers – far from it – we did worry in case the quarrels turned violent. I expressed my concern to Pak Abu but he said we should just sit tight and ride the storm, as it were. And we did, until yesterday.

The pandemonium started just after we completed our subuh prayers early yesterday morning. There was the usual shouting and screaming, followed by lots of stomping and clanging sounds (of pots and pans thrown at each other?).

Much as I was annoyed, I was also amused at the same time because the lyrics of P Ramlee’s song suddenly came to mind: “Periuk belanga terbang melayang-layang, menghentam my belakang…”

The clamour, carried by the still morning air, was such that it felt as though our ceiling was about to cave through. I could see poor Pak Abu’s temperature rising by the moment. Is this what we moved to this presumably high-end condo for?

Suddenly we heard a woman’s voice yelling: “Ooooiii, bulan puasa niiiii!!!” Moments later a man’s voice boomed: “Takder malu langsung!!”

Immediately the din ceased. Bless my unseen neighbours for taking the lead. They must have been exasperated beyond reason to do what they did.

Nonetheless, an irate Pak Abu went down to the security guard station, at six o’clock in the morning, to lodge a complaint. I followed up with another report at the management office a few hours later, only to learn I wasn’t the first.

Without divulging any more than I should, I was surprised to find out the occupant’s identity; quite a well-known personality from the entertainment industry. I just hope that from now on they will keep their domestic scuffles at a manageable noise level.

[I am so very tempted to slip a note under their door, giving them contact numbers of professionals who could soundproof their pad. Honest!]

Pelangi Utama Condo residents in a dilemma

The following article from Star Online is not really our kind of problem here at Desaminium…YET, but parking problem is common in ALL high-rise buildings especially residential buildings. Don’t local council building laws have specific rules and requirements on the parking-residential unit ratios at any high rise development projects? Have you seen the same problem in Cyberjaya? Cars are parked along the road. Aren’t the developers supposed to provide reasonably sufficient parking spaces for residents and visitors? If Desaminium occupancy reaches close to 100% later, we definitely have big problems staring at our face… sooner or later.

IMAGINE waking up in the morning to find a parking summons on your car’s windshield and this happens three or four times in a month, almost once a week.

That is what some residents and tenants of Pelangi Utama Condominium in Petaling Jaya have been experiencing lately.
Parking woes: Due to limited parking space, some of the Pelangi condo residents have no choice but to park along the road.

Damon Khaw moved in to the condo in July but has already received three summonses in August.

“My condo is not facing the road so I don’t know when the officers will come to issue summonses. One was even issued at 10.30pm on the eve of Merdeka,” he said.

“It sets us back about RM400 per month, which is almost 10% of our income.

“This has a big impact on our lives, especially with the high cost of almost everything since the petrol price increase,” he said.

Khaw and his wife each own a car but they were only allocated one parking lot.

“I bought the condo unit through a sub-sale. Thus, I would have to go through the first owner to apply for another parking lot,” he said.

“To apply for another parking lot will cost RM150 per month and it is subject to a drawing of lots since there are only 10 units left,” he said.

Khaw said he had raised this issue at the joint management body (JMB) committee meetings.

Aside from the summonses, safety is also one of his concerns.

“Sometimes, we park at the nearby shops and walk to the condo. I’m worried for my wife’s safety when she comes back from work late,” he said.

“It is also troublesome as we are not able to renew our road tax due to the summonses,” he said.

Khaw hopes that the Petaling Jaya City Council (MBPJ) can allocate proper parking spaces for the condo residents.

His neighbour, who wanted to be only known as Epey, said other residents also faced the same problem.

“There should be some parking space for rent. I am so fed up that I want to move out. Why do we have to face this problem?” she asked.

Student Johnson Chua finds it difficult to fork out RM150 per month for a parking lot.

“I have moved in for less than a year and so far, I have received three summonses,” he said.

“I take turns with my housemate to park at the allocated parking lot.

“Sometimes, I park at the nearby shops but the space there is limited,” Chua said.

“It’s troublesome for me to travel all the way to pay my summonses, especially since I’m not local,” said the 20-year-old student from Malacca.

“I hope that the MBPJ will allocate a certain period of time, such as from night to dawn, for us to park for free,” Chua said.

Tangki air Desaminium Rimba pecah

Pada hari Ahad 30/3/08, penghuni Block Keruing Desaminium Rimba telah digemparkan dengan satu bunyi dentuman yang kuat kira-kira jam 11:00 pagi akibat dari tangki air di tingkat 20 telah pecah. Saya telah dimaklumkan mengenai kebocoran tangki air tersebut pada hari Jumaat oleh penghuni tingkat 20, dan beliau telah melaporkan kepada pihak YBR. namun kerja-kerja pembaikan dijangka akan dibuat pada hari Isnin 31/3. Jadi pada pagi tersebut saya telah merakamkan beberapa keping gambar untuk rekod (kira-kira jam 9:30 pagi) dan telah memaklumkan kepada pihak YBR. Untuk rekod tangki tersebut telah 2 kali bocor sebelum ini dan telah ditampal oleh pihak kontraktor. Namun kira-kira jam 11:00 pagi sewaktu saya masih berada di tingkat 20 tiba-tiba kedengaran bunyi dentuman yang kuat dan air yang deras telah melimpah dari atas akibat dari tangki air itu telah pecah. ini telah mengakibatkan kerosakan harta benda penghuni tingkat 20 dan membahayakan nyawa penghuni tersebut. Dua laporan polis telah dibuat mengenai kejadian tersebut. Untuk tatapan umum disertakan gambar-gambar sebelum dan selepas tangki tersebut pecah.
